Bu Kullanım Koşulları (“Koşullar”), Dijital Danışmanın LLC tarafından sunulan Menugo hizmetinin ve menugo.tr web sitesinin kullanımına ilişkin kuralları belirler. Siteyi ziyaret ederek veya hizmeti kullanarak bu Koşulları kabul etmiş sayılırsınız.
1. Taraflar ve kabul
Hizmet sağlayıcı: Dijital Danışmanın LLC (“Menugo”, “biz”). Kullanıcı: web sitesini ziyaret eden kişi veya hizmeti satın alan/işleten işletme (“Siz”). Teklif formu göndererek veya hizmet sözleşmesi imzalayarak güncel Koşullara bağlı olursunuz.
2. Hizmetin tanımı
Menugo; işletmelerin menülerini QR kod aracılığıyla dijitale taşımasına, yönetmesine ve misafirlere sunmasına olanak tanıyan bir yazılım hizmetidir (SaaS). Hazır sabit paketler yerine işletmeye özel teklif üzerinden sunulur. Özellikler teklif ve sözleşme kapsamında belirlenir.
3. Hesap ve kabul edilebilir kullanım
- Hesap bilgilerinizin gizliliğinden ve hesabınız üzerinden yapılan işlemlerden siz sorumlusunuz.
- Hizmeti yasa dışı, zararlı, yanıltıcı veya üçüncü kişi haklarını ihlal eden amaçlarla kullanamazsınız.
- Sisteme yetkisiz erişim, tersine mühendislik veya hizmeti bozmaya yönelik girişimler yasaktır.
- Menü ve işletme bilgilerinizin doğru ve güncel tutulması sizin sorumluluğunuzdadır.
4. İçerik sorumluluğu
Menü metinleri, fiyatlar, görseller, alerjen bilgileri, kampanya duyuruları ve benzeri içeriklerin doğruluğu, yasallığı ve güncelliği işletmeye aittir. Menugo içerik sağlayıcı değildir; yasal zorunluluk veya güvenlik gerekçesiyle içeriği kaldırma / askıya alma hakkını saklı tutar.
5. Ücretlendirme ve ödeme
Fiyatlandırma işletmeye özel teklifte belirtilir. Kurulum ve ilk menü girişi teklifte aksi yazılmadıkça ücretsizdir. Ödeme koşulları, dönem ve yenileme ilgili sözleşmede yer alır. Ödeme yapılmaması halinde hizmet askıya alınabilir.
6. Fikri mülkiyet
Menugo yazılımı, markası, tasarımı, arayüzü ve dokümantasyonu Şirkete aittir. Size yalnızca sözleşmede tanımlanan kapsamda kullanım hakkı verilir. İşlettiğiniz menü içeriğinin fikri hakları size aittir; hizmeti sunmak için gerekli lisansları Şirkete vermiş sayılırınız.
7. Garanti ve sorumluluk sınırı
Hizmet “olduğu gibi” sunulur; kesintisiz veya hatasız çalışma taahhüt edilmez, ancak makul uptime hedeflenir. Kanunların izin verdiği ölçüde Şirket; dolaylı, arızi veya kar kaybı dahil sonuç zararlarından sorumlu tutulamaz. Zorunlu tüketici hakları saklıdır.
8. Fesih
Sözleşme süresi ve fesih şartları yazılı teklif / sözleşmede belirtilir. Uzun vadeli taahhüt zorunluluğu bulunmayan planlarda dönem sonunda iptal edilebilir. Fesih sonrası verilerinizin teslimi veya silinmesi talebinize ve mevzuata göre yürütülür.
9. Uygulanacak hukuk ve uyuşmazlık
Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda İstanbul (Çağlayan) mahkemeleri ve icra daireleri yetkilidir; zorunlu tüketici hakları ve yetki kuralları saklıdır.
These Terms of Use (“Terms”) set out the rules for using the Menugo service and the menugo.tr website provided by Dijital Danışmanın LLC. By visiting the site or using the service, you are deemed to accept these Terms.
1. Parties and acceptance
Provider: Dijital Danışmanın LLC (“Menugo”, “we”). User: a visitor of the website or a business that purchases/operates the service (“You”). By submitting a quote form or signing a service agreement, you become bound by the current Terms.
2. Service description
Menugo is a software service (SaaS) that enables businesses to digitize, manage and present menus via QR codes. It is offered through custom quotes rather than fixed off-the-shelf packages. Features are defined in the quote and agreement.
3. Account and acceptable use
- You are responsible for the confidentiality of your account credentials and for activity under your account.
- You may not use the service for unlawful, harmful, misleading purposes or in violation of third-party rights.
- Unauthorized access, reverse engineering or attempts to disrupt the service are prohibited.
- Keeping menu and business information accurate and up to date is your responsibility.
4. Content responsibility
Accuracy, legality and currency of menu texts, prices, images, allergen information, campaign announcements and similar content belong to the business. Menugo is not a content publisher; it reserves the right to remove or suspend content for legal or security reasons.
5. Pricing and payment
Pricing is stated in the custom quote. Setup and initial menu entry are free unless the quote says otherwise. Payment terms, period and renewal are set out in the relevant agreement. The service may be suspended in case of non-payment.
6. Intellectual property
The Menugo software, brand, design, interface and documentation belong to the Company. You are granted only a right to use within the scope defined in the agreement. Intellectual rights in your menu content belong to you; you are deemed to grant the Company the licenses necessary to provide the service.
7. Warranty and limitation of liability
The service is provided “as is”; uninterrupted or error-free operation is not warranted, though reasonable uptime is targeted. To the extent permitted by law, the Company is not liable for indirect, incidental or consequential damages including loss of profit. Mandatory consumer rights remain reserved.
8. Termination
Term and termination conditions are stated in the written quote / agreement. Plans without long-term commitment may be cancelled at the end of the period. After termination, delivery or deletion of your data is handled upon request and in accordance with law.
9. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye. Istanbul (Çağlayan) courts and enforcement offices have jurisdiction; mandatory consumer rights and venue rules remain reserved.
